Introduction
These are our terms and conditions. These Terms and Conditions always apply when you use our Website or place an order through our Website and they contain important information for you as a buyer. Read them carefully. We also recommend that you save or print these terms and conditions for future reference.

 

Article 1. Definitions
1.1. Marleen Suzanne Art: established in The Hague and registered with the Chamber of Commerce under file number 82049327, trading under the name Marleen Suzanne Art. 
1.2. Website: the Website of Marleen Suzanne Art, which can be found at www.marleensuzanne.com and all its sub-domains.
1.3. Customer: the natural person or company that enters into an agreement with Marleen Suzanne Art and/or is registered on the Website.
1.4. Agreement: any agreement or agreement between Marleen Suzanne Art and the Customer of which the General Terms and Conditions form an integral part.
1.5. General conditions: these general conditions.
 
Article 2. Applicability of the General Terms and Conditions
2.1. The General Terms and Conditions apply to all offers, agreements and deliveries of Marleen Suzanne Art, unless expressly agreed otherwise in writing.
2.2. If the Customer contains provisions in his order, confirmation or any other message stating that the General Terms and Conditions have been accepted that deviate from or are not included in the General Terms and Conditions, these provisions only bind Marleen Suzanne Art if and insofar as Marleen Suzanne Art has accepted it in writing.
2.3. In cases where, in addition to these general terms and conditions, specific product or service-related terms and conditions also apply, the Customer can always invoke the applicable condition that is most favorable to him in the event of incompatible general terms and conditions.
 
Article 3. Prices and information
3.1. All prices stated on the Website and in other materials sourced from Marleen Suzanne Art include taxes and other government levies, unless otherwise stated on the website.
3.2. If shipping costs are charged, these will be stated clearly and in good time before the conclusion of the agreement. These costs are also shown separately in the ordering process.
3.3. The content of the Website has been compiled with the greatest care. However, Marleen Suzanne Art cannot guarantee that all information on the Website is correct and complete at all times. All prices and other information stated on the Website and in other materials from Marleen Suzanne Art are subject to obvious programming and typing errors.
3.4. Marleen Suzanne Art cannot be held responsible for color deviations resulting from the quality of the colors displayed on the screen.
 
Article 4. Conclusion of the Agreement
4.1. The Agreement is concluded at the moment that the Customer accepts the offer of Marleen Suzanne Art under the conditions set by Marleen Suzanne Art.
4.2. If the Customer has accepted the offer electronically, Marleen Suzanne Art will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of the acceptance has not been confirmed, the Customer has the option to dissolve the Agreement.
4.3. If it appears that the Client has provided incorrect information when accepting or otherwise entering into the Agreement, Marleen Suzanne Art has the right to suspend the Agreement until the correct information has been received.
 
Article 5. Performance of the Agreement
5.1. As soon as Marleen Suzanne Art has received the order, she will immediately send the products to the Consumer with due observance of the provisions of paragraph 3 of this article.
5.2. Marleen Suzanne Art is authorized to engage third parties in the fulfillment of its obligations under the Agreement.
5.3. The delivery term is in principle 14. Delivery can take place in various ways, at the discretion of Marleen Suzanne Art.
5.4. If Marleen Suzanne Art cannot deliver the products within the agreed term, she will inform the Consumer of this. In that case, the consumer can decide either to agree on a new delivery date or to dissolve the Agreement without costs.
5.5. Marleen Suzanne Art advises the Consumer to inspect the products on delivery and to report any defects within a reasonable time, preferably in writing or by e-mail. For more details, see the article on warranty and conformity.
5.6. The risks associated with the products pass to the Consumer as soon as the products have been delivered to the agreed delivery address.
5.7. If the ordered product is no longer available, Marleen Suzanne Art is entitled to deliver a product that is comparable in nature and quality to the ordered product. In that case, the consumer has the right to dissolve the Agreement without costs and to return the product free of charge.
 
Article 6. Right of withdrawal/return
6.1. This article only applies if the Consumer is a natural person who is not acting in his professional or commercial capacity. Business Consumers therefore have no right of withdrawal.
6.2. The consumer has the right to dissolve the distance contract with Marleen Suzanne Art within 14 days of receipt of the product free of charge and without stating reasons.
6.3. The term starts on the day after receipt of the product by the consumer, or a third party designated by the consumer, who is not the carrier, or:
if the delivery of a product includes several deliveries or parts: the day on which the Consumer, or a third party designated by the Consumer, has received the last delivery or the last part;
in the case of agreements for regular delivery of products during a certain period: the day on which the consumer, or a third party designated by the consumer, has received the last product;
if the Consumer has ordered several products: the day on which the Consumer, or a third party designated by the Consumer, has received the last product.
6.4. Only the direct costs incurred for the return shipment are for the account of the Consumer. This means that the Consumer must pay the costs of returning the product. Any shipping costs paid by the Consumer and the purchase amount of the product will be refunded to the Consumer when the entire order is returned.
6.5. During the reflection period referred to in paragraph 1, the consumer will handle the product and packaging with care. The consumer may not open the packaging or use the product, unless this is necessary to determine the nature of the products, their characteristics and their functioning.
6.6. The consumer is only liable for depreciation of the product that is the result of handling the product other than what is permitted.
6.7. The consumer can dissolve the agreement in accordance with paragraph 1 of this article by reporting the withdrawal (digitally or in another form) to Marleen Suzanne Art within the reflection period by means of the model form for the right of withdrawal or in another unambiguous way. If Marleen Suzanne Art makes it possible for the Consumer to report his withdrawal electronically/digitally, Marleen Suzanne Art will immediately send a confirmation of receipt after receiving such a statement.
6.8. As soon as possible, but no later than 14 days after the day of notification as referred to in paragraph 1, the consumer returns the product or hands it over to (an authorized representative of) Marleen Suzanne Art. The consumer can send the product directly to Marleen Suzanne Art within the period referred to in paragraph 1 without prior notification of withdrawal. In that case, the consumer must add a written notice of withdrawal, such as the model form. The return address is on your order confirmation.
6.9. Any amounts already paid (in advance) by the Consumer will be refunded to the Consumer as soon as possible, but no later than 14 days after the termination of the Agreement. If the Consumer opts for a more expensive method of delivery instead of the cheapest standard delivery, Marleen Suzanne Art does not have to reimburse the additional costs of the more expensive method. Except in cases where Marleen Suzanne Art has offered to collect the product himself, he may wait with repayment until he has received the product or until the consumer demonstrates that he has returned the product, whichever is earlier.
6.10. Information about whether or not to apply a right of withdrawal and any required procedure will be clearly posted on the Website well before the Agreement is concluded.
 
Article 7. Payment
7.1. The Customer will pay the amounts owed to Marleen Suzanne Art in accordance with the order procedure and any payment methods indicated on the Website. Marleen Suzanne Art is free to offer any payment method of choice and can change it at any time. When paying after delivery, the customer receives a payment term of 14 days, starting on the day after delivery. 
7.1. If the Customer fails to fulfill its payment obligation, it will owe statutory interest on the late payment. Marleen Suzanne Art must remind the Customer of the late payment and Marleen Suzanne Art must give the Customer a period of 14 days to meet the payment obligation. After the expiry of this period of 14 days, Marleen Suzanne Art is entitled to recover any extrajudicial collection costs from the Customer. These collection costs do not exceed: 15% of the outstanding payment with a maximum of € 2,500; 10% of the next €2,500 and 5% of the next €5,000 with a minimum of €40. Marleen Suzanne Art is allowed to deviate from the stated amounts and percentages in the benefits of the Client.
 
Article 8. Warranty and Conformity
8.1. This article only applies if the Consumer is a natural person who is not acting in his professional or commercial capacity. If Marleen Suzanne Art provides a separate guarantee on the products, this applies, without prejudice to the above, to all types of Consumers.
8.2. Marleen Suzanne Art guarantees that the products comply with the Agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and with the existing legal provisions and/or government regulations that come into effect from the date of arrival. to be. in the Agreement. If specifically agreed, Marleen Suzanne Art also guarantees that the product is suitable for other than normal use.
8.3. If the delivered product does not comply with the Agreement, the Consumer must inform Marleen Suzanne Art of this within a reasonable time after he has discovered the defect.
8.4. If Marleen Suzanne Art considers the complaint to be well-founded, the defective product(s) will be repaired, replaced or refunded in consultation with the Consumer. The maximum amount of the compensation is, in view of the article liability, equal to the price that the Consumer has paid for the product.
 
Article 9. Complaints handling procedure
9.1. If the Customer has complaints in connection with a product (in accordance with the article on warranty and conformity) and/or about other aspects of the services of Marleen Suzanne Art, he can submit a complaint by telephone, by e-mail or by post. See the contact details at the bottom of the Terms and Conditions.
9.2. Marleen Suzanne Art will respond to the complaint as soon as possible, but in any case within 7 days of receipt. If it is not yet possible for Marleen Suzanne Art to formulate a substantive response to the complaint by that time, Marleen Suzanne Art will confirm receipt within 7 days of receipt of the complaint and indicate the term within which she expects to respond. . be able to provide a substantive or definitive response to the Customer's complaint.

Article 10. Personal data
10.1. Marleen Suzanne Art will process the personal data of the Consumer in accordance with the privacy statement, which can be found at https://www.marleensuzanne.com/privacy-policy.
 
Article 11. Final provisions
11.1. The law of the country of establishment of the webshop applies to this agreement.
11.2. Insofar as not dictated otherwise by mandatory law, all disputes that may arise as a result of the Agreement will be submitted to the competent Dutch court in the district where Marleen Suzanne Art is located.
11.3. If any provision of these General Terms and Conditions should prove to be invalid, this will not affect the validity of the General Terms and Conditions as a whole. In that case, the parties will determine one or more new provisions to replace them, which will reflect the original provision as much as possible.
11.4. In these General Terms and Conditions, 'written' also includes communication by e-mail and fax, provided that the identity of the sender and the integrity of the e-mail message are sufficiently established.

1.  Fulfill your order
We will use your personal information when fulfilling your order. We may share your information with the delivery service to have your order delivered. We may also obtain information about your payment from your bank or credit card company.
